Canada’s Phthalates Regulations limit DEHP, DBP and BBP to 1,000 mg/kg in the vinyl of toys and child-care articles, and DINP, DIDP and DNOP in parts a child can mouth. California’s Proposition 65 lists several phthalates and lead. If your finished goods go on to the EU, REACH Annex XVII restricts the same phthalates at 0.1%, limits lead in PVC to below 0.1% since 29 November 2024, and limits cadmium to 0.01% in PVC and polyurethane mixtures — which reaches the compound itself. Ask for test reports per grade, in this company’s name.

What does a US importer of compounds have to certify?

Under the Toxic Substances Control Act the importer certifies at entry either that the chemical substances in the shipment comply with TSCA or that they are not subject to it; the procedure is in 19 CFR 12.118 to 12.127. A substance that is not on the TSCA Inventory is a new chemical and needs a premanufacture notice 90 days ahead; polymers can qualify for an exemption that has its own criteria and reporting. Ask the supplier for a written TSCA statement covering every component of the grade.

What about Vietnam, the Philippines and the Gulf?

Vietnam’s Law on Chemicals 69/2025/QH15, effective 1 January 2026, requires registration of new chemicals, GHS labelling, a safety data sheet and an import declaration. The Philippines controls chemicals through its inventory (PICCS) and pre-manufacture notification, offers a polymer exemption that has to be applied for, and has applied GHS labelling to mixtures since 2019. For the Gulf states only a draft GHS-aligned standard was found; no registration requirement was confirmed. Your importer’s broker should confirm the current position.

Which HS codes usually apply?

Under HS 2022, other poly(vinyl chloride) in primary forms falls under 3904.21 (non-plasticised) or 3904.22 (plasticised), polyurethanes in primary forms under 3909.50, and unvulcanised compounded rubber under heading 4005. Where a rubber-plastic blend or the “PCU” material falls depends on its base resin, which is one more reason to ask for the composition. Classification is decided by customs at import.
